Kena retrench, company only offer 2 weeks pay per year. Betul ke?

Worked 6 years at a logistics company in Shah Alam. HR called me in, say company downsizing, offer me 2 weeks salary for every year served. Is this the correct amount or they trying to shortchange me? Feeling blur right now.

Under the Employment (Termination and Lay-Off Benefits) Regulations, the MINIMUM is: less than 2 years service = 10 days per year, 2 to 5 years = 15 days per year, more than 5 years = 20 days per year. You worked 6 years so you should get 20 days (not 2 weeks/10 days!) per year. They are lowballing you lah. Print out the regulation, go back and negotiate. If they refuse, lodge complaint at Jabatan Tenaga Kerja (Labour Department) - it is free. I did this in 2019 and got my correct amount plus notice pay.

Check your salary ceiling also. The Employment Act now covers all employees regardless of salary (since 2023), so you are protected. Ask for it in black and white. Good luck bro, been there, it stings but you will bounce back liao.

Dont sign anything on the spot ah. Tell them you need time to review. Once you sign the settlement, susah nak claim more later. I signed too fast last time and lost my notice-in-lieu pay. Take the letter home, google or ask lawyer friend first.

Also dont forget you can claim SOCSO Employment Insurance System (EIS). Go to any PERKESO office or apply online within 60 days of losing job. They give you monthly allowance while you cari kerja, plus free job matching and training. Helped me a lot masa pandemic when my hotel closed down.
